Пришла сдать документы для перевода дома в собственность,отказали,сказали,что дом 3 на 4 нельзя перевести в собственность! Как нельзя,если разрешение на строительство от архитектуры на руках! Позвонила в архитектуру,сказали можно!Сказали подавайте документы,если откажут,то подавайте в суд. Они будто в другом государстве живут

Из Ваших пояснений следует, что органы архитектуры выдали Вам разрешение на строительство индивидуального жилого дома общей площадью 12 кв.м. Согласно п. 4.5. Свода правил 55.133330.2016 Дома жилые одноквартирные, дом должен включать в себя жилые комнаты (хотя бы одну) и вспомогательные помещения. При этом согласно п. 6.1. названных правил площади помещений домов должны быть не менее: общей комнаты – 16 кв.м., (при одной жилой комнате 14 кв.м.), кухни 9 кв.м., следовательно, установленная законодательством площадь индивидуального жилого дома должна быть не менее 23 кв.м. При этом наша организация не может брать на себя ответственность за выдачу уполномоченными органами разрешительной документации на строительство, противоречащей нормам действующего законодательства. Обращаем Ваше внимание, что в приеме документов Вам не отказывали, но предупредили о том, что если при обследовании объекта будет установлено несоответствие его параметров требованиям действующего законодательства, то подготовка технической документации, необходимой для ввода в эксплуатацию индивидуального жилого дома, невозможна.
